Child in Custody of Resident Facility Settles his Injury Case
Our client was a full-time resident of a local resident facility that treats children with various behavioral problems. One evening in January, the staff instructed the residents to run in the dark from the gymnasium to the resident’s cottage. There were no lights in this area of the campus and the staff were following the boys in their personal vehicle “to light the roadway”. During the jog back to the cottage, our client fell down in extreme pain. There was a dispute as to whether the staff vehicle struck the youth or whether he tripped due to a pot hole on the roadway. Discovery revealed multiple violations with the handling of the resident by staff workers. The client fractured his leg and required surgery. The resident facility settled the case for $450,000.
