1.  Take Photographs. Use your cell phone to photograph the defective condition. Many times the defect will no longer be present later to take pictures. Documenting the defective area – water on the  floor, uneven sidewalk, pothole in parking lot, etc. – can be the difference in winning and losing your case.  

2. Report the Fall. If possible, report the fall to the landowner or store owner right away. Ask for a copy of any incident report that is filled out. Ask for the person’s name and write it down. If you fell at a store or restaurant, save your receipt as proof of being present.
